Hi, I'm going to build a trellis at the top of the stairs and I've understood that the gap between the slats must not exceed 10cm. My question is whether there are any rules about how elastic the slats can be? My slats are 26 x 80 mm in oak. It's a real hassle to split, glue, and plane them to make them wider!

Maybe there's a rule somewhere, but it feels irrelevant. The rule is there to prevent children from being able to stick their heads in the gap and get stuck. If you think from that perspective, you'll probably get an idea yourself of what's okay.

my thought is that if the slats are too soft, it's easy to bend them apart, and then the gap is more than 10 cm!

Don't know!
I was just thinking one step further when it comes to the distance!
 
Just place them closer together, so it doesn't matter if they can bend a little.
